1. Agreement

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and Built In Wardrobes Sydney Pty Ltd (ABN: 73 628 451 892) (“Company,” “we,” “our,” or “us”) governing the use of our services and website.

By engaging our services or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Services

2.1 Scope of Services

We provide:

  • Custom wardrobe design and consultation
  • Manufacturing of wardrobe systems
  • Delivery and installation services
  • Warranty and after-sales support
  • Related storage solutions

2.2 Service Standards

All services are provided in accordance with:

  • Australian Consumer Law
  • Building Code of Australia
  • Relevant Australian Standards
  • Fair Trading NSW requirements

3. Quotes and Orders

3.1 Quotes

  • Quotes are valid for 30 days from issue date
  • Quotes are estimates based on information provided
  • Final price may vary if specifications change
  • GST is included in all quoted prices

3.2 Order Acceptance

  • Orders are accepted upon receipt of signed quote and deposit
  • We reserve the right to refuse any order
  • Order confirmation will be provided in writing
  • Changes after acceptance may incur additional charges

3.3 Measurements

  • Customer must verify all measurements
  • We accept no liability for customer-provided measurements
  • Professional measurement service available for a fee
  • Re-measurement charges apply for customer errors

4. Pricing and Payment

4.1 Payment Terms

  • 50% deposit required to commence production
  • Balance due on day of installation
  • Payment methods: Cash, bank transfer, credit card
  • Credit card payments may incur surcharge

4.2 Late Payment

  • Overdue accounts incur 1.5% monthly interest
  • We may suspend services for overdue accounts
  • Legal costs for debt recovery are customer’s responsibility
  • Products remain our property until fully paid

4.3 Price Variations

We reserve the right to adjust prices for:

  • Material cost increases exceeding 10%
  • Changes to specifications
  • Additional work discovered during installation
  • Access difficulties not previously disclosed

5. Manufacturing and Delivery

5.1 Lead Times

  • Standard lead time: 2-3 weeks from deposit
  • Complex projects may require longer
  • Delays beyond our control do not constitute breach
  • We will notify you of any significant delays

5.2 Delivery

  • Delivery charges may apply outside standard areas
  • Customer must ensure adequate access
  • Risk passes to customer upon delivery
  • Inspection required at time of delivery

6. Installation

6.1 Installation Services

  • Professional installation by qualified tradespeople
  • Compliance with relevant building standards
  • Basic cleanup of installation area
  • Demonstration of product features

6.2 Customer Obligations

Customer must:

  • Provide clear access to work area
  • Ensure walls/floors are ready for installation
  • Have authorized adult present during installation
  • Complete any required preparatory work

6.3 Variations

  • Additional work must be agreed in writing
  • Variations charged at standard hourly rates
  • Customer-requested changes may delay completion
  • Structural issues are customer’s responsibility

7. Warranties

7.1 Warranty Coverage

  • 10-year structural warranty on cabinetry
  • 5-year warranty on moving parts and hardware
  • 2-year warranty on electrical components
  • Warranty period commences from installation date

7.2 Warranty Exclusions

Warranty does not cover:

  • Normal wear and tear
  • Misuse or abuse
  • Unauthorized modifications
  • Damage from water, fire, or other external causes
  • Products not installed by us

7.3 Warranty Claims

  • Claims must be made in writing
  • Photos of defects may be required
  • We will repair or replace at our discretion
  • Customer must provide reasonable access for repairs

8. Cancellations and Refunds

8.1 Cancellation by Customer

  • Before production: Full deposit refund less $500 design fee
  • During production: Deposit forfeited
  • After production: Full payment required
  • Custom orders cannot be cancelled once production begins

8.2 Cancellation by Company

We may cancel orders for:

  • Non-payment of deposit
  • Failure to provide required information
  • Discovered structural issues
  • Force majeure events

8.3 Refund Policy

Refunds are provided only for:

  • Defective products we cannot repair/replace
  • Services not provided as agreed
  • Cancellations per Section 8.1
  • As required by Australian Consumer Law

9. Limitation of Liability

9.1 Exclusions

To the maximum extent permitted by law, we exclude liability for:

  • Indirect or consequential losses
  • Loss of profits or revenue
  • Property damage beyond our work
  • Delays due to factors beyond our control

9.2 Liability Cap

Our total liability is limited to:

  • The amount paid for the relevant product/service
  • Repair or replacement of defective products
  • Re-supply of services

9.3 Consumer Guarantees

Nothing in these Terms excludes, restricts, or modifies consumer guarantees under the Australian Consumer Law that cannot be excluded.

10. Intellectual Property

10.1 Our Property

All designs, plans, and specifications remain our property unless:

  • Full payment received
  • Specific written agreement transfers ownership

10.2 Customer Content

You warrant that any content you provide:

  • Does not infringe third-party rights
  • Can be used by us for providing services
  • Is accurate and complete

11. Privacy

Your personal information is handled according to our Privacy Policy. By using our services, you consent to such processing.

13. General Provisions

13.1 Entire Agreement

These Terms constitute the entire agreement unless modified in writing.

13.2 Severability

If any provision is invalid, the remaining provisions continue in effect.

13.3 Waiver

No waiver is effective unless in writing and signed by us.

13.4 Assignment

You may not assign your rights without our written consent.

13.5 Governing Law

These Terms are governed by the laws of New South Wales, Australia.

14. Definitions

  • Australian Consumer Law: Schedule 2 of the Competition and Consumer Act 2010 (Cth)
  • Business Day: Monday to Friday, excluding public holidays
  • Defect: Fault in materials or workmanship
  • GST: Goods and Services Tax
  • Installation Date: Date installation is completed
